Website Terms and Conditions - Version 1.1

These terms and conditions ('Terms') apply to all information posted for use by general public and services provided to any person ('Customer') by eDance NSW Description of Goods and Services.

Our vision is to provide an online entry facility for eisteddfods and an affordable comprehensive listing of all dance related businesses. We will maintain our site on an ongoing basis, so that all information is up to date and fresh, ensuring visitors to eDance get the most accurate information about eisteddfods and the latest products and services available to them.

We aim to attract as many visitors as possible to the eDance site who have an interest in dance, thereby exposing and linking customers to businesses which support their love of dance.

Eisteddfod Listings

The basic listing of an eisteddfod is free and will include eisteddfod name & logo, location, competition date, entry closing date, contact name, contact phone no., mailing address, email address, link to website (if applicable), categories offered. A listing can be applied for by emailing enquiries@edance.com.au.

At the end of the calendar year, a reminder email will be sent by eDance to the nominated eisteddfod contact. The email will request if the event should be relisted for the following year. Should there be no response, within one calendar month of the reminder email, eDance will remove the event from the eDance eisteddfod directory.

We also provide an easy online entry facility for eisteddfods that choose this registration option with our site. For a personalised quotation email us at eisteddfods@edance.com.au.

Eisteddfod Entries

General public competitors are able to enter those eisteddfods registered with eDance via the online entry form. For registered eisteddfods refer Eisteddfods.

Option of credit card payment through a secure eWAY gateway, posted cheque/money order or direct deposit is offered. For more details see eDance Security Policy.

It is the sole responsibility of the competitor to familiarise themselves with the rules of each eisteddfod and to read the eDance terms and conditions prior to finalising their entry. eDance bears no responsibility for details entered incorrectly by any competitor due to but not limited to personal misrepresentation, typing errors, incorrect section selections, misreading or misinterpreting of eisteddfod rules, internet or computer malfunction, lost or delayed mail or failed fax or email.

Entries will only be finalised on receipt and clearance of full payment to eDance.

If no payment is received within 5 working days of the date of online entry a reminder email will be sent to the entry contact.

Should full payment not be received by eDance within two working days of the close of late entries date, the entry will be cancelled and cheque returned unopened.

On receipt of payment an email confirming payment will be sent to the email address as nominated by the entrant.

No competitor may enter under a name other than his or her own legal name and entries are not transferable from one person to another or from one eisteddfod to another.

Competitors participate at their own risk and agree that they are in good health and have adequate fitness for safe participation eDance reserves the right to amend or refuse any entry. But will always endeavour to correspond via email or phone should the need for entry clarification arise.

Any enquiries regarding each eisteddfod entry may be made via email at eisteddfods@edance.com.au or by phone on 0401 598 857 up until the closing date of entries for that eisteddfod. After the closing of entries date all entry details become the responsibility of the eisteddfod's nominated co-ordinator. Refer to the individual eisteddfod's syllabus for contact details.


A range of affordable advertising for the dance community and other related services is available including directory listings, client dedicated web pages, advertising strips and banners. For current rates and terms please make your enquiry to enquiries@edance.com.au.

The Customer will assume responsibility for all content of advertisements and syllabus published, including names, portraits, text, representations or any sketch, map works, labels, trademarks or other copyrighted matter.

Advertising for publication will not be accepted without supply of customer contact details including full name and street address of the customer. PO Box and email address alone are insufficient.

All prices displayed on Advertising and syllabus copy must include any GST applicable or specify the GST component in accordance with Australian Government legislation.

All eDance charges and fees are in Australian dollars.

eDance reserves the right to refuse any advertisement submitted for publication, but will always inform you of our reasons.

eDance reserves the right to place the word “advertisement” above or below any copy which in eDance's opinion resembles editorial matter.

eDance makes no warranties in relation to proximity of publication of copy relating to competing products or services eDance in no way endorses any services or products advertised on this website. Agreements or transaction entered into between customers and advertisers are not covered by the terms of this website.

All directory listings (except Eisteddfod listings, which are covered separately in this document), will be listed for a period of one year from the entry date (i.e. the date that you enter your details online, regardless of how long until we receive payment). No listing will be displayed on the edance.com.au directory until receipt of full payment (and in the case of cheques, cheque clearance from the bank). A reminder email will be sent one month before the listing is due to expire, giving you the option to renew your listing and to update any details on your listing. Any amendments to key information, such as address or phone number during the one year period will be accepted by email.

A change to your business name will be deemed a new listing and will be subject to a new listing agreement and fee.

If a listing is removed from the site prior to the expiry of the one year agreement, no refund will be payable.


eDance Privacy Policy Introduction

eDance regards customer privacy as an important part of our relationship with our customers. The following privacy policy applies to all eDance users and customers, and complies with Australian Government legislation and information privacy principles (IPPs).

Collection of Information

In order to use the eDance website, we may require information from you in order to provide the best service possible.

All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including email.

Any information collected by eDance is collected via correspondence from you or your company. This may be via the telephone, email, mail, fax or directly through our website.

Use of Collection Information

Any details collected from eDance customers are required in order to provide you with our products and/or services, and a high level of customer service.

Please note that the information you supply must be true and correct to enable the processing of entries. All information will be passed on to the Eisteddfod Committee for each Eisteddfod you enter.

Correspondence is recorded in order to provide service references, and to assist in our staff development.

Storage of Collected Information

The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

Access to Collected Information

If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by emailing us at enquiries@edance.com.au.


If you purchase a product or service from us, we may request certain personally identifiable information from you. You may be required to provide contact information (such as name, email, and postal address) and financial information (such as credit card number, expiration date).

We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.


eDance uses personally identifiable information for essential communications, such as emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at enquiries@edance.com.au.

You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.

Third Parties

eDance may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service.

These third parties are prohibited from using your personally identifiable information for any other purpose.

eDance does not share any information with third parties for any unknown or unrelated uses.


We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.


Links on the eDance site to external entities are not covered within this policy. The terms and conditions set out in this privacy statement only cover the domain name of eDance.com.au.

Changes to Privacy Policy

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of the changes.


eDance Security Policy

At eDance, we are aware of the security and privacy issues surrounding the use of the internet Note:- Credit Card payments are processed by eWay and no credit card details are retained by eDance, nor passed on to the Eisteddfod Committee (only the fact that you have paid) for each Eisteddfod you enter.

eDance uses the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants,providing a safe and secure means of collecting payments via the Internet.

All online credit card transactions performed on this site using the eWAY gateway are secured.

Credit card payments

Payments are fully automated with an immediate response.

Your complete credit card number cannot be viewed by eDance or any outside party.

All transactions are performed under 128 Bit SSL Certificate.

All transaction data is encrypted for storage within eWAY's bank-grade data centre, further protecting your credit card data.

eWAY is an authorised third party processor for all the major Australian banks.

eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by eDance.

Payment by cheque or money order

All cheques and money orders are to be made to eDance NSW and posted to eDance NSW, PO Box 214, Kingsgrove Post Shop, Kingsgrove, 1480.

Please mark the back of each cheque/money order with your name and directory to be listed on (or for Eisteddfod online entries, the competitors name, entry number and eisteddfods entered) so that it can be easily identified for processing your entry.

Entries will only be finalised on receipt and clearance of cheques by eDance.

Should a cheque be dishonored the customer is liable to reimburse eDance for all related bank fees incurred. Entry will not be finalised until said fees are paid and replacement cheque cleared.

If no payment is received within 5 working days of the date of online entry a reminder email will be sent to the entry contact.

Should payment not be received by eDance within two working days of the close of late entries date, the entry will be cancelled and cheque returned unopened.

Payment by Direct Deposit

If paying by direct deposit please email eisteddfods@edance.com.au within three working days the following information: Date of payment, direct deposit receipt number, competitors name, entry number, and eisteddfods entered.

Entries will only be finalised on receipt of full payment and all payment information.

If no payment is received within 5 working days of the date of online entry a reminder email will be sent to the entry contact.

Should payment not be received by eDance within two working days of the close of late entries date, the entry will be cancelled and an email notification sent to the entry contact.

Delivery Policy

After ordering online, you will receive an email confirmation from eDance containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your goods via post within 28 working days; however if goods are unavailable delivery will take a little longer.

After ordering or entering online, you will receive an email confirmation from eDance containing your order/entry details. We will normally confirm receipt of your order within a few minutes of ordering.

Refund & Returns Policy

Up until close of eisteddfod entries date no refund will be given for an entry incorrectly entered by the competitor or for change of mind by the competitor. A refund or purchase adjustment may be sought if the entry has been incorrectly charged due to website malfunction. Please email us at eisteddfods@edance.com.au if this occurs and we will endeavor to resolve the issue as soon as possible. After the close of entries date all entries and refunds are the responsibility of the eisteddfod's nominated coordinator. Any refund will then be at the discretion of that coordinator guided by the syllabus for that eisteddfod. Please refer to the eisteddfod's syllabus for contact details.

If an eisteddfod is cancelled before the entries close date eDance will cancel entries and refund all money collected for that eisteddfod. If an eisteddfod is cancelled after the close of entries date those entries and refunds are the responsibility of that eisteddfod's committee. Please refer to the refund policy outlined in the eisteddfod's syllabus.

If for any reason you are not completely satisfied with your purchase we will give you a 30 day money-back guarantee (original purchase price of goods only not including postage) from the time you receive the goods. Please email us at enquiries@edance.com.au within that time if you are not satisfied with your purchase so that we can resolve any problems.

This refund policy does not apply to goods which have been worn or used, damaged after delivery, or if any attempt has been made to alter the product or if they have been dropped or broken. All products must be returned in their original condition. All postage and insurance costs are to be paid by the buyer. We recommend that you return the product via Registered post and that you pre pay all postage. You assume any risk of lost, theft or damaged goods during transit & therefore advise you take out shipment registration of insurance with your postal carrier. eDance will not be responsible for parcels lost or damaged in transit if you choose not to insure.


By submitting Advertising for publication, the Customer warrants to eDance that the Advertising or syllabus does not breach or infringe:

a. the Trade Practices Act (Commonwealth), Fair Trading Acts (State) and equivalent legislation;

b. State and Commonwealth anti-discrimination legislation and child protection legislation;

c. any copyright, trade mark, obligation of confidentiality or other legal rights of any person;

d. any law of defamation or obscenity;

e. any law of contempt of any court, tribunal or royal commission;

f. the Privacy Act (Commonwealth);

g. any other law (including but not limited to any common law, statute, delegated legislation, rule and ordinance of the Commonwealth or any State or Territory)

h. and is not false, deceptive or misleading or contain anything which may give rise to any cause of action by a third party against eDance, including without limitation material which is defamatory, obscene, libelous, threatening, harassing or which otherwise causes injury or damage to any person.

i. does not contain any malicious code data or set of instructions that intentionally or unintentionally causes harm or subverts the intended function of the eDance website, including, but not limited to viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;


In no event shall eDance, it's employees, agents or affiliates and their employees and agents be liable for any incidental, indirect, exemplary, punitive and/or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the website.


The Customer indemnifies eDance, it's employees, agents and affiliates, and their employees and agents against any action, claim, loss or expense arising from publication of Copy or cancellation or failure to publish and all costs, losses and expenses suffered or incurred by eDance, its employees, agents and affiliates, and their employees and agents as a result of any breach by said Customer of these conditions or any agreement between the Customer and eDance.


All pages and content displayed on eDance.com.au are the copyright of eDance NSW. This includes, but is not limited to, advertising pages, customer web pages, online entry form and directory listings.

No images or content may be copied, reproduced or used without the express permission of eDance NSW.


These conditions and any agreement between the Customer and eDance will be governed by New South Wales law and each party submits to the jurisdiction of courts exercising jurisdiction in that State.

This Agreement may be assigned by eDance to a third party without your consent in the event of a sale or other transfer of some or all of the assets of eDance. In the event of any sale or transfer you will remain bound by the Agreement.

Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.

Sales include advertising content, directory listings, eisteddfod entries, products.

Customer means any member of the general public using the eDance website for information or to enter an eisteddfod and anyone purchasing products or services through the eDance website.
